Several Authorities, One Business: What Comes First? (SSM, Business Licence, Signboard, TNB)
The following is a hypothetical case, not a real client.
The scenario
Mr Tan has rented an industrial unit in Kuala Lumpur and plans to open a small processing workshop. His list reads: SSM registration, a DBKL business licence, a signboard, electricity, and the fire certificate a friend mentioned. His first question to us: “With all of this, what do I do first?”
Our usual answer: don’t queue up yet. Assess first.
Four questions to answer first
- The premises: is it a newly completed unit, or one that has been used before?
- The business activity: what exactly will you do there? Processing only, or also retail on site and a signboard?
- The jurisdiction: which local authority covers the unit? Kuala Lumpur falls under DBKL; elsewhere, the local PBT.
- Where things stand: is the business registered? Is the tenancy signed? Is power already there, or does it need a new or larger supply?
Different answers can mean a different order.
What each authority covers
- SSM (Companies Commission of Malaysia): handles business and company registration. The Registration of Businesses Act 1956 (Act 197) states that registering a business under the Act does not mean the requirements of other laws for that business have been met [S1]. SSM’s list of owner responsibilities also includes obtaining the licences, permits or letters of approval required by the relevant authorities [S2]. In other words, SSM registration is only one step.
- DBKL (Kuala Lumpur): DBKL’s Licensing and Business Development Department issues business premises licences and advertisement (signboard) licences, among others, and enforces them [S3]. Outside Kuala Lumpur, check the local PBT’s official requirements.
- TNB (electricity): TNB has two application routes based on load. Smaller loads are submitted by an electrical contractor registered with the Energy Commission; larger loads by an electrical consultant engineer registered with the Board of Engineers Malaysia [S4][S5]. For a company applicant, TNB’s document list includes the registration certificate and proof of occupancy of the premises, such as a tenancy agreement [S6].
- Fire (Bomba): whether this applies, and how to apply, depends on the category of premises. We could not open Bomba’s official page to verify it, so we are not listing specific requirements here. This is to be confirmed with the relevant authority.
How to think about the order
Some links are visible from the above. When applying for electricity in a company’s name, TNB asks for documents such as the registration certificate and the tenancy agreement [S6]. So in this hypothetical case, registration and the tenancy come before the electricity application. Business and signboard licences are decided by the local authority [S3], and requirements and procedures may differ from place to place.
That is why we don’t hand out a “standard order” table. A steadier approach:
- answer the four questions first;
- list the authorities this business may involve;
- check each authority’s current published requirements, and see which document is a prerequisite for another application;
- where something is unclear, ask the authority directly.
Everything is subject to each authority’s published requirements at the time, and practice may differ between areas.
Application assistance and follow-up
Applications are made in the business owner’s name and are usually submitted by the owner; some authorities accept a letter of authorisation. Our team provides application assistance and follow-up: we help you identify which authorities are involved, prepare a document checklist, help prepare the application materials, and follow up on progress. We will never ask for your system passwords. Approval and timing are decided by the authority.
Next step
Send us three things: your business activity, the unit address, and where things stand now (registration, tenancy, electricity). We will help you map out which authorities are involved, then work out the order together.
Disclaimer
This article is for general information only and is not legal advice; the case is hypothetical, and the relevant authority’s published requirements prevail.
